What happen if i refuse to accept a police caution?
Q. I have been accused of assault by a traffic warden. I have not been arrested or charged, i attended the police station when requested to put my side of the story and now i have been contacted by the police telling me to attend to receive a caution. I do not want this because as i understand it accepting a caution is an admission of guilt, and i do not believe i am guilty. What will happen if i refuse to accept it, what legal rights do i have etc.

A. I ran a successful Jury trial recently on the basis that my client had been offered a caution and refused it. Bear in mind that a caution is offered when 1. there is an admission of guilt and 2. it is not in the public interest to take the case to Court. My point to the Jury - and your point too if you're game - is that he was offered a slap on the wrists but refused to take it on the basis that he'd done nothing wrong. Decent evidence to suggest that he had in fact done nothing wrong. Cautions aren't offered to everyone (although they are a lot more common than they used to be). A. If the 2 and 26 made green flag stops under green they would have went down at least a lap when the yellow came out. Johnson on pit road when the caution came out change two tires to get out before the pace car came around. 2 and 26 probably got their lap(s) back or were on the tail end of the lead lap when it went back green. As Johnson only needed one side when every one else came in for probably 4 tires, he was able to get out faster. That is why Johnson was like the 7th car in the top line but the leader. The cars in front of him were on the tail end of the lead lap.

How long does it stay on your CRB if you were arrested and interviewed under caution?
Q. All charges were dropped and nothing else came of it. I didn't receive a caution. I am aware that an interview will still come up on an enhanced CRB check.

A. 7 years, but it will state that no charges where pressed, once in the system it stays there until the 7 years have passed then goes to microfilm, but can't be bought up in court after the 7 years and won't be an active file after then, but it sounds like you don't have too much to worry about unless you do the same thing again, hope this helps, goodluck! :)

Q. I have a Police Caution dating back 7 years, for possession of a small amount of cannabis (while I was suffering from cancer). My new company wants me to go to the US on business occassionally (they don't know about my caustion) I have an interview booked in the US embassy in Jan 07. A. You were cautioned, you weren't prosecuted, you weren't found guilty. Just cautioned. That is not a conviction, that's why there's nothing on your police report. Your police report would contain anything that was of interest. I was cautioned as a kid, after that I passed a number of different evaluations by people who had full access to all records (even went back to my secondary school to interview people there). No problems. By the way, glad you survived the cancer.

A. You can still apply. It will be up to the person who is in charge of hiring and interviews to decide if you should still be worth hiring. I think you still have a chance; hopefully your record and resume is clean and high quality and maybe the rest will be overlooked. Also, I think it gives you hope still just because it was a caution and not an actual charge.

How can I remove a Police Caution from a CRB Disclosure certificate?
Q. I received my Disclosure back and it shows a caution I received almost 5 years ago. I have read in numerous places that I can apply, after 5 years from the date of the caution, to have it removed. A. I've looked around on this one and it seems that this is a little bit of a grey area - convictions become spent after a certain period, depending on the offence. However, cautions are not covered by this and are technically never spent - although by the same token, they are not a conviction either and not even the CRB website has any answers about this. It may be that it remains on there. However, I would speak to the CRB on 0870 90 90 811. Remember though, just because they are a big organisation, it doesn't mean they don't get things wrong. They've been on watchdog a couple of times because they have said people have criminal convictions when they haven't. Best of luck with it.

But although a lot of people mean well here on Yahoo Answers, not all answers given by people are always genuine/helpful as they can be misinformed, et cetera and I think it's always best (particulary with serious if not urgent) medical, health queries that persons arrange consultation with their doctor rather than resort to finding the answers on the internet. A. I guess the generic legal disclaimer covers that. I wouldn't rely solely on advice given on Yahoo! Answers for anything. I have posted a few questions, not about health, that did provide useful information on which to base decisions in real life. The questions I answer are ones that I know an answer for. I'm a Respiratory Therapist (RRT) in real life, fully licensed and tested, etc... When I answer something, I know that the person asking it doesn't just want to hear "talk to your doctor" every time. Duh! I'm sure they already knew that. So, what I do is try to give the person information that might help them figure-out what is happening or about what would happen with a certain course of treatment. A. It is more like a warning. A first time dog owner can in reality obtain a breed who has been deemed "not for first time dog owners", but most shouldn't. It's like a firm recommendation, dogs who are labelled "not for first time dog owners" are put into this category because it can be hard for someone with no experience to properly integrate the dog into their family/life. They may have trouble asserting themselves as the pack leader, it could be a breed known to be more aggressive, it could even be that the dog is smart and will find a first time owners training flaws and use them to their advantage. A. Unless you have been formally charged you should have no problem. Obtaining a HGV licence requires a medical in any way, so any problems would be dealt with there.
